Mylan Inc. will pay the state of Pennsylvania $8.3 million for overcharging the state for its EpiPen emergency allergy treatment.
The payment is part of a $456 million dollar settlement with the U.S. Justice Department after the company was accused of false claims about the treatment for Medicaid use.
The figure was announced by Pennsylvania Attorney General Josh Shapiro who said the settlement involved allegations that Mylan knowingly underpaid rebates owed to state Medicaid programs for the EpiPen by classifying it as a generic instead of brand name drug for years.
The settlement covers the period of July 2010 to March 2017. Earlier this year Mylan faced intense public criticism, and was ordered to testify to Congress, about the 400+ percent of the cost of the pens in recent years, many of which are required in public schools at taxpayer expense.
Mylan has since offered a more generic version of the pens which help those with severe allergic reactions.
